Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else’s small babies. She it seems had come here last year and taken care of someone else’s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old – who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.
This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?
What are we going to do with that money man? This is nothing but a greediness.
Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.
Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?

I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US and came back to my home town. Have been working here for 6 years now as in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?

Now I think some major clarifications are needed here. The Receipt Date (RD) that is printed on the I-485 receipt is the date whenever queuing according to RD is needed. This is THE date wherever a FIFO is required and is as assigned as soon as the envelope containing the I-485 is received.
The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).
That said whenever I talked to NSC officers (not the National Customer SC non-officers or regional call center IIO's or Infopass ignoramuses) ..officers who personally were aware of the going on's at the service center they said the Notice date does not carry any value for case adjudication priorities and the CLAIMS 3 systems only sequences (or sweeps as they call it) as per the PD and RD (when needed).
Further, since I see all the notes made for my approved I-485 (thro' FOIA) including the worksheet completed by contractors. I clearly do not see any notations mentioned with reference to the ND on it...
That said, for the OP, since your RD is very close to the "official" processing date there are all chances that your application might have already gone under the eyes of a CAO (Center Adjudication Officer). Call NSC directly and ask since you are so close and especially since your date is going current next month....you want to make sure that your file is either pre-adjudicated OR assigned to an officer.
Normally, RD (on your receipt), and actual data entry date followed by the notice should be in quick succession. Logically, ND is just a notice date, therefore, when questioned they are correct in saying that ND has no relevance for any processing decisions. Due to high volumes of July/Aug 07, a lot of case files were just lying in warehouses for months before a center agreed to accept them. That's why you see online RD so different (and very close to ND).
If your statement in your first para is true, centers will have to do a lot of work for manually sorting thousands of cases before placing them in cabinets, which is quite impractical. Unless somebody is forcing them to do so, it is highly unlikely to happen. Note that issues under discussion are impacted by high volumes of July/Aug 07 for which systems are not designed. Also, as most cases are not PD dependant, USCIS systems don't handle them well, as they are not designed for handling PD based cases efficiently.

No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. Is this period (July 1st 2004 to Feb 28th 2005) considered as Legal Status assuming the following scenario
1.company Applied for H1 transfer on July 1st 2004
2.Started taking Training from the companyfrom July 1st 2004 and finished Training on 30th Aug 2004
3.Started the client project and got payslips from Sep1st 2004 till 15th Feb 2005
4.Got employment letter from company from July 1st 2004 to 28th Feb 2005

I know you guys have been doing a great job. I joined around july last year and have been a regular visitor to your site. Actually, I was just active on the thread that GCStatus has started. I dont think he ever used derogatory statements against any of the admin. Infact, he has posted for a help from admin on more than 4 occassions with out any proper response. Actually, If you look at this thread, it was some one else who had commented admins are on vacation and will not be back until july 2009. It was not GCStatus who said that. He just replied to that . He had no clue about what you guys are up to. So let us stop this leadership fight. Now that, you have clearly told you cannot hardwire that thread on the front page. Well, we cant do much about it now, since we are at your help here. If you think, GCStatus has said any thing bad about you, please can you post it, because i did not find any comments about admin.

Do you want me to post them here? Now lets get back to "ownership" and "rudeness" debate because it always turns out that way. You can say anything and if Admin responds, all of a sudden Admin is showing attitude, Admin is rude, freedom of speech, Ist amendment, Admins is dictators, Admins are like Hitler etc etc . Nothing new, we have seen this story repeat countless times.
And one more thing, you are busy and others have all the free time in the world. Is that right?
We never received any email from you. I think you mean 4-5 posts. We did not believe that there was merit in responding to your posts. There is only so much time in a day. We can not practically respond to most of the posts, even if we want. But as I mentioned earlier, not responding to a post doesn't give you license to be rude and then later call it a joke. Its not funny because we take this effort very seriously. Our information is in public domain and we are very much reachable. Whereas you have put in bogus information in your profile and we think that using anonymous handle, you are attacking this effort. With this effort we have developed think skin because we have heard a lot of times from naysayers. But sometimes, like today, we do feel the need to respond to needless attacks/nagging/poking.
