Following up on my previous post. Here is the format for the ad and the affidavit. We went to the DC embassy to get the name changed and they have next day (business days only) passport-by-mail service. I don't think they have same day service.
Actual correct name: <corr_first_name> <corr_last_name>
Current Name on passport: <first_name_pp>
Name in US docs (Visa, SSN, Drivers Lic.):
<first_name_us> FNU _OR_ <first_name_us> <first_name_us>

We found out at the embassy that we could have used our India issued marriage certificate (which had my wifes correct name) and avoid doing all this. Placing the ad, getting the affidavit and posting it to US all took a total of 1 week. We went to the DC embassy early on a Friday and we got the passport with the name changed via mail by Monday.
Another friend of mine got the same thing done via the mail-in service. It took him 2 weeks to get the passport back.

Yes, I agree. Preadjudication by no means, is a confirmed decision. It is just do as much as possible, but when the time comes, re-review the case - which can result in RFE for anything. Nothing is confirmed until decison is made. Be positive and hope for the best...

Hi,
My company is located in CA state. Currenlty i am working in Client place i.e in Oregon state.
My labor and I140 got approved in my old residence CA address.Now i applied I485 for me and my wife by showing Oregon state address thorugh my same employer which is located in CA state.
Pls clarify, wheather this new address will make any impact on my I485 process(approval).Becoz some ppl in forums are mentioning that, if we don't have LCA for new state then I485 maybe denied becoz of "out of status".
pls help in this regard.:)

I am EB3-I (pd 02 retrogressed) but was interested in this discussion so i emailed my lawyer about it. She said, historically the last month of the fiscal year has the most approvals as they try to clear as much as they can. You will see a lot more approvals from next week or sept 2nd week.
As you guys may already know. When a 485 file is with an adjudicating officer, h/she then is able to request a number via an online portal from the State Dept with the relevant case details.
I am hearing that for the last few days when EB2 India/China numbers are requested, instead of granted or not, the officers are getting a "pending" status report. They can't adjudicate without the number being approved from the State Dep't.
The same thing is not happening with ROW cases. Of course all of this is ridiculous and unfair but judging from last years events, I suppose we are to expect this. So it appears that the state Dep't might be doing some internal calculations. Not sure if they are trying to get info back from consular posts as well before they release the rest to the service centers.
However what is clear is that all is definitely not smooth with the communication at this time. Hopefully they will get it together and in the end not waste numbers. NSC was really slow off the mark earlier this month and those of us with old pending cases there, appear to have been the losers this rounds.
I'm praying they have numbers left over for next month. Based on what we are seeing they seem have gone into ramping down for Aug. already.

Hi,
We filed for my wife's H-1B under Masters Quota on April 30th and sent the application packet to Vermont Service Center. But on May 3rd UCSIS sent back the packet which we received on May 11th. They also sent a letter saying that the application be sent to Laguna Niguel (CA Service Center) instead.
Do you know if we can resend the application to Laguna Niguel now -- i.e., after the H-1B Master Cap is reached? If we can, then from which H-1B pool will USCIS issue the H-1B approval?
Has this happened to anyone before?

Actually we were called for interview at the local uscis, : My RD was Aug-17-2007 and the ND is Oct-15-2007. The DAO - District Adjudication Offcier gave me a heart attack saying that we are not eligible for GC as the cut-off date was 17-Aug and we were out of the window. Then I politely explained her, and then she looked at the RD and said that we would be fine. Also I called USCIS last week, and told that I filed on Aug, one rep said that they go by ND, I called again and the other rep said that "by ND". Not sure, may be uscis itself is not sure.
Anyhow, is it advisable to take an infopass now (i.e) before september . Wouldn't it be better to visit uscis office in september, so that we could strongly say that "We are current, and could something be done about our case".
I'm afraid that, if we go to uscis now saying that "We will be current in Sep", the uscis people might ask us come back again in Sep. And remember, we cannot have two consecutive infopass within 45 day. So what do you suggest?

Is this period (July 1st 2004 to Feb 28th 2005) considered as Legal Status assuming the following scenario
1.company Applied for H1 transfer on July 1st 2004
2.Started taking Training from the companyfrom July 1st 2004 and finished Training on 30th Aug 2004
3.Started the client project and got payslips from Sep1st 2004 till 15th Feb 2005
4.Got employment letter from company from July 1st 2004 to 28th Feb 2005
If I am not mistaken, you can start working for a new employer as soon as they apply for a H1 transfer. You have 240 day period, in which it must be approved. You should be ok, assuming that you got the approval within 240 days of July 1st 2004.

The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).
That said whenever I talked to NSC officers (not the National Customer SC non-officers or regional call center IIO's or Infopass ignoramuses) ..officers who personally were aware of the going on's at the service center they said the Notice date does not carry any value for case adjudication priorities and the CLAIMS 3 systems only sequences (or sweeps as they call it) as per the PD and RD (when needed).
Further, since I see all the notes made for my approved I-485 (thro' FOIA) including the worksheet completed by contractors. I clearly do not see any notations mentioned with reference to the ND on it...
That said, for the OP, since your RD is very close to the "official" processing date there are all chances that your application might have already gone under the eyes of a CAO (Center Adjudication Officer). Call NSC directly and ask since you are so close and especially since your date is going current next month....you want to make sure that your file is either pre-adjudicated OR assigned to an officer.
Normally, RD (on your receipt), and actual data entry date followed by the notice should be in quick succession. Logically, ND is just a notice date, therefore, when questioned they are correct in saying that ND has no relevance for any processing decisions. Due to high volumes of July/Aug 07, a lot of case files were just lying in warehouses for months before a center agreed to accept them. That's why you see online RD so different (and very close to ND).
If your statement in your first para is true, centers will have to do a lot of work for manually sorting thousands of cases before placing them in cabinets, which is quite impractical. Unless somebody is forcing them to do so, it is highly unlikely to happen. Note that issues under discussion are impacted by high volumes of July/Aug 07 for which systems are not designed. Also, as most cases are not PD dependant, USCIS systems don't handle them well, as they are not designed for handling PD based cases efficiently.

This is crazy. I hope they do something about it at least for students who have advanced degrees from US colleges. Not because they are smarter, but because they are already here and have contributed a lot of $$ to US schools.

There is a lot of work done in the background and by the state chapters that you may not be aware of. for example when i was a member of a state chapter a volunteer printed 5000 pamplets and we spent a weekend distributing them. One volunteer was actively involved in collecting and mailing out letters for the letter writing campaingn. there are some who visit every temple and talk about IV. These people dont post on the forums or beg for red, blue or green dots, they do the best they can. On the other hand many come to the forums with a 'grand plan' and hope someone else will doe the rest. Most are so self absorbed that they would rather spend time debating how their application is superior and how they should get GCs first. The same people end up volunteering each time while the rest demand answers and ask why bills are not passed. I can also give specific examples of people who posted that they participated in a campaign simply to get green dots. The final straw for me was the EB2 Vs EB3. Each person has his/her threshold, and i am positive that the core will feel the same way some day.
State chapters contribute a lot in grassroots efforts. Couple of months back, a delegation from Tri State area, Texas, North Carolina, Michigan, Massuchettes and other places went to DC and met with all our politicians - Iv arranged everything for us and we planned these visits well through state chapters - our lobbyist guided us well and also accompanied us to some meetings. We were around 15 people and we personally felt we did something to help ourselves and the community.
Some chapters do a lot of publicity campaigns. Like for the admin fix campaign, The leader from North California (Abhijeet) took special permission from the cops and distributed flyers in train stations and got hundreds of people sign the letters.
One very dedicated member (nolaindian32) started the IV running cluib to collect donations towards lobbying
Walking_dude along with some other IV members testified in Michigan senate when MI drivers lisence issue was going on
On a regular basis IV members in DC area do meet with govt officials and have meetings, talk to media and involve in whatever ways possible.
All these people who are working for IV are just ordinary folks like rajuram and do not have any special degree. They have shown commitment and have decided they will take a step forward and help.
There are hundreds of other examples of how hard IV members work behind the scenes.
A lot of talented people come to IV and come up with brilliant ideas for execution - all brilliant folks must put their great minds to work by doing something for IV.

How many 2004 EB2-I are pending? Per the FY2008 DHS Statistics 25,777 PRs were approved. But we dont how many of these EB1, EB2, and EB3.
