I applied for my 2nd visa extension (1-year extension) after completion of 6 years in the middle of March 2007 (before I-94 expiry). My I-94 expired in the middle of March. I didn't hear from USCIS until the middle of July when they sent a huge list of request for evidence regarding my case (although I've been working on the same company's H1s for last many years now).
Meanwhile, I applied for adjustment of status on July 2nd as a beneficiary on my wife's application. If my H-1B gets rejected after sending the request for evidence for some reason now will I be out of status? Since my 180 days from my last valid I-94 will expire in the middle of September, is it a good idea to go on H4 before the middle of September and reenter the country?
In worst case, what will be my status if USCIS gets back to me, say in October, and says my H-1B extension application has been rejected?
Any input from UN or other gurus is appreciated.
Since you're a beneficiary of you're wife's AOS, you're in "pending status of authorized stay". Therefore you *are* authorized to stay here as of that day until a decision on the 485 is made (the unlawful stay clock stops ticking). If you get rejected on your H1 extension, you can still stay in the country and possibly work on the EAD (a derivative benefit of the 485). If you think your wife's 485 is airtight, and there's a problem later you can use the 245(k) provision since you were in unlawful stay for less than 180 days.

You still have Eb3 to eb2 conversions, labor subs etc. So 1 lakh 485 including dependents is good for 2004 and 2005. With per country quota of 3800 + row scraps I still think a person with PD 2006 Eb2 will wait a decade to get his green card or end up at Silicon valley of India, Bangalore.

I came across this website last year in November. I got active in December, and contributed, and tried to get active in my state chapter.
When I come across posts that want to remove country caps, or some other measure that is going to be harmful to me, I have to stop and ask myself if I am shooting myself in the foot by supporting IV.
Its not about whats fair. Nor about what common sense is. Its about self-interest.
If we are increasing the size of the pie, then it benefits me (ROW) to be here. If we are to fight each other over crumbs, then it doesn't.

When I read the memo, I was more worried about my name check and whether she would check the status of it than about this, as anyhow my dates are not current. After showing the memo, she did offer to check the status.
With all the experience our guys have with USCIS officers and staff, it's hard to belive an IO would be that helpful? But, she's and even the staff at this office is not as bad as others have experienced.
I was even telling my wife about the behaviour and how staff at other offices behave.
Which USCIS Center did you go to. The best thing here would be that someone else also go to the same USCIS Center and can hopefully talk to the same IO officer. If she shows the memo again then we can get more information out of it.

Yes, that would suffice as a name change in the passport. My situation was as follows.
Passport:
Surname: Y**** Z****
Given name: X****
I requested for an observation from SFO consulate and got it corrected to the following format.
Surname: Z****
Given name: X**** Y****
I got this done through mail and these were the documents required
1. Passport
2. $10 Cashiers cheque
3. Miscellaneous service form
4. self addressed and prepaid usps envelope
5. Cover letter
I guess as long as you dont change the spelling of your name, you do not require an advertisement or affidavit for getting it corrected.

as many are aware, there was a huge rush to buy and sell pre-approved labors during july-august 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable gc seekers, who hadn�t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month eb3-i stood at november 2001. Now it is completely unavailable. It can�t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that gc process alive. In all likelihood he/she must have moved on in life.
There is only one explanation. These labors were already pre-approved. It is the attached i-140 on these labors that are getting approved rapidly. And the subsequent i-485 petitions on these applications are depleting the visa numbers.
The reason of this post is not to start an argument about the ethics of labor substitution. It is just a fyi post to explain the seemingly inexplicable. The chickens are coming home to roost.

I am going to file my h1 application tomorrow under the master's qouta. I know its nearly impossible that my petition would be approved but I have no other choice. I just have one question:
1. Should I go for a premium processing?

A simpler suggestion would be to permit citizenship after 5 years of continuous lawful residence in the US...drop the word "permanent" from that law, and go straight from L-1 to USC, do not pass LPR, do not spend $10,000!:D
But seriously...It would actually fix a lot of problems for those who want US Citizenship, and because those would no longer apply for immigrant visas, those numbers would be available for those who do not wish to become US citizens.
