No RFE, SR on 8/27/09 - Recd reply on 9/4/09 stating that your case is pending and processing is delayed. Called two senators offices and sent them faxes, Lawyer sent a letter to AILA liason on 8/20/09 - So far no replies
Called TSC on 9/15/09 eve 5 PM and talked to CSR and she convinced and transferred to officer, he told me that the case is under review since 8/28/08 and asked me to keep faith in the system
And by 7 PM EDT - 9/15/09 recd the CPO - email for both of us

I do agree that my success (both personal and professional) depends on:
1) Ability to file I-485 so my wife can start working. She has a MS in Computer Science degree which she acquired while on H4, which in an itself is a major accomplishment. But, she can't do much beyond this. Lots of employers stay away from filing H1 these days. So her best bet is get EAD soon so she can start working.
2) Ability to file I-485 gives the benefit of visa-stamp-less travel. We've been postponing traveling to India due to the hassles involved in H1 stamping.
3) Ability to get greencard will give us peace of mind for sure.
I do know IV is working to reduce backlogs, remove per-country quota, admin fixes, and much more. I do not of any other platform that is helping employment based immigrants...which is why I'm participating in the advocacy days and I just contributed $100 towards the cause.
I hope IV slowly but surely gets enough mass of people to become a self-sustaining organization that can make impact to the lives of immigrants. You and other IV volunteers are surely doing a great job.

First off, any DOL complaint don't need u to be here to continue with the investigation. The way it works is, u tell them ur entire story and leave. They'd take their time to investigate using all the documentation u'd have provided them, and in the end if ur employer was found guilty, they might still let him off the hook giving him a warning. There's really no guarantee that ur employer wud be found at fault unless they find more employees lodge complaints against him. U might be the only one.
Anyhow, u can give it a shot and see what happens as u have nothing to lose. I know that ppl hv tried this b4 without much luck. Employers hire attorneys to save them from such situations. Ur employer closing down shutters is a far fetched thought...just saying...US laws are quite tricky.
H1 transfer at this point may not really work for u as u dont hv paystubs. Sorry, its a bad situation to be in. I understand u paid from ur pockets to come here and it sucks - Good luck!

I guess it was my employers discretion to make me sit home with him just not responding to my mails, i couldn't barge in to his office and say hey give me desk to work on? can i ?
Anyways looking at the LCA agreement i think you don't seem to know what you are talking about, I am here holding his company's name on my H1B form , His agreement on LCA and his employment letter, i dunno if there is any other way i could make inroads into barging into his office?
Now if he puts a security guard against me entering his office, shouldn't i report this to DOL too?

The FEAR I see among many people is really pathatic, I know couple of friends does not even want to talk to me on phone about this matter thinking that some one might be listening,

Firstly, its a movie. Secondly even if its true, what's there to be afraid of??? If you talk on the phone about legal course of action to lobby, why would you be afraid of.
Like I said, you have to give some credit to the Irish. They have the chutzpah of going to lawmaker's offices in DC and say "I am an illegal...I broke the laws and overstayed my visa...please change to law to make everything ok again for me please...". And our community thinks that someone is listening to their phone conversation about how to raise money and lobby for the legal immigrants?????

I agree that recapturing lost no's from previous years will be the best possible solution.But to do that we need intervention from the congress and the President needs to sign a bill to recapture the lost no's.To accomplish this goal we need to keep up the momentum generated from this june bulletin fiasco and intensify our lobbying efforts in Washington.
Kudo's to the IV core for their strong campaign in championing our cause.

I do not mean to be negative, but this immigration debacle does not seem to end. How long do we have to freaking endure this nightmare? IV has been trying for months now...When do you think we will have immigration relief? Are we just going to end up being like thirsty deers in a desert chasing a mirage in search for water?

I believe it will be the same old story. They will wait till last quarter and then will waste thousands of visa numbers because of their darn slow processing hands and we people will again start talking optimism from Oct 2010.

I am wondering the same for 2002 applicants. I wonder if many people were approved in 2007 fiasco and if yes, then why PD is stuck at Nov 2001?
I am also thinking the same that many might have been approved in 2007, because most of these applicants had a chance to apply before the gates were closed in 2005, and would have been approved in 2007. But 0 responses is still odd.
The reasons for Nov 2001 PD could be due to backlog processing centers that held sway over these applicants (non-RIR cases), but by same yardstick, there still should be some cases in early 2002. Odd indeed (though a good kind of "odd", as we will get a welcome jump in dates once they ball starts rolling).

there is nothing wrong in expressing but taking a category and calling them body shoped is not the right way to express ...
You have a valid point about gctest. But again, there is no way EB2/EB3 gets to port to EB1. If it was so, then it would be a chaos here. Only porting that happens is E3 to EB2 and may be that's why he used EB3 in his post.

Wow, you must have written some letter... This is the first time that i have heard someone getting a call about NC from the presidents office.
You are right.. I got a call this Wednesday from the Presidents office of initiating an inquiry on my case and again a repeated call from them on Friday that FBI Name Check has been cleared. I forgot to mention this detail in my excitement.

I am not sure if its legal or not but various members can contribute their skills in exchange of donation to IV. This way members with skills are giving their time to IV and Members of the forum are getting sound advice/guidance/service for small contribution to IV. Examples can be many like CPA, Tax preparation, Doctors, career guidance, Online tutoring, Software consutlancy. I am sure all the members are "SKILLED" in various walks of life.
