I would strongly suggest everyone to acquaint himself/herself with the legislative process and how a bill moves through different phases / steps before it becomes a law. You can find many postings documenting the process.
Right now it is just introduced in the senate. The problem for us is that Sen Durbin is Democratic Whip (i.e. Assistant Majority Leader) which gives him tremendous influence over garnering votes and referring which legislation to consider to the Majority Leader (Harry Reid in the Senate). Ultimately Reid decides which legislation get priority consideration. The fact that Grassley is a Republican and is close to the Minority Leader (I think) does not help us either. We will monitor the progress of the bill.
Question to IV core.

Guys , I think this issue has been discussed lot of times.
1) USCIS do not allot immigrant visas, It is alloted by DOS.
2) DOS needs a fix in the current EB laws to capture unused visa.
3) I am not sure if we can push any change in law, given the current Iraq war quagmire.
But I hope they speed up the overall application processing times, with all the increased Fee money they will get from July 30th (by investing money on IT).
With the increased fees...Are they ready to promise us they will decreasing the processing times... and not waste visa numbers...

What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option.
Or they have way more options than you or me!! Don't envy those guys who move around the world like free birds not thinking twice about leaving the green card process half way, and unlike us they probably will earn more after leaving US. Your post shows lots of frustration..... take it easy man!:D

More likely cause is that the letter from the applicant notifying his new job never reached/registered in CIS systems.
Did the person send the letter in time? Was there any intermediate change in status between NOID and actual denial status? This is crucial to know before jumping to conclusions.

My question to UN and other gurus. Does it have anything to do with a changed interpretation? My lawyer says "This is a training issue - the new officer did not know about AC21 and as soon as he/she saw 140 as revoked - just ignored your other details on the case and issued a denial notice. This is very common and can be resolved using MTR"

I got responses from pappu and Logiclife during the months of december and january. I didn't ask them any questions in Feb. so I did not notice they were quiet.

And, if everybody was promised the current system, then there should never be any change, ever, because whenever you make any change, it will be unfair to the people who are waiting at that time, right? Even the increase in numbers or recapture is unfair because when we applied, we did not know if recapture will happen, right? So why change. Open your eye, there was no promise made to you or to anybody else, the system has evolved and will continue to evolve while we continue to wait for approval. What we are seeing and hearing in congress is the overwhelming ignorance and lack of understanding of the contributions made by H1B and GC aspirants to the US economy. There is the wise saying that "Everything happens for a good reason". We have been trying so hard for last 2-3 years to make these politicians realize and to make corporate America realize that they need to do something about our problems because of our value proposition. Apparently all these calls have only backfired and caused the anti-immigrationists to lobby even harder and pull the strings of politicians to make them do as they please. Whether we like it or not, unless the raw brunt of a mass exodus of educated work force is not felt by this country, there is no way for them to understand how wrong they are. EB category has never had loyal support. All of the corporate america support has rested on the need for H1B. We have been abused by this system and forced to feel that we have abused this system. I think we have been told in a million ways by now that we need to find a Plan B. I feel bad yet no remorse for the thousands of H1Bs who do nothing to support the cause of organizations like IV. As someone once said, most of them are very laid back and will not worry about the problems untill someone tells them to buy their return tickets back home. We are very happy with eating samosa and tea and do not have the perspective to realize what threats lie on the horizon. I say this based on actual conversations with some of these people who literally scoff at me and think I am off my rocker when I discuss the repurcussions of no reforms. Like the prehistoric animals who did nothing to adapt in the full view of changing environmental conditions, these laid back folks will realize only too late.

This fellow who wrote this might be one of those arm chair critics who just criticizes everything if it doesn't favor that individual. What a moron. I am sure this fellow is clueless about how much effort is put into to make a legislation.
There has been lot of work done by many IV volunteers just to get a bill introduced. It is so stupid just to trash talk the efforts put in by the selfless IV volunteers.
All IV members has to be proud that we have been able to get a bill that addresses the GC backlogs. Hey one year back lawmakers were clueless about EB GC issues. Now majority of the lawmakers atleast have an understanding about EB GC issues. It is a matter of time before we succeed.
The easiest guage for the success of the IV efforts is to see the response U get from the lawmakers when U write to them about GC issues. Earlier U used to get a generic reply about undocumented workers and broken borders, nowadays U would be getting replies that talk about EB immigration. Isn't that an achievement. As a professional aren't U proud that U are give the respect U deserve rather than getting clubbed with undocumented workers. Ask for U'r self?

I also got email from CRIS last night stating that my I-129 has been reopened.
I have a very simple immigration history:
I-129 filed and approved April 2005, petition expires 3/30/2008; only ever worked for this same company.
No H-1B extensions ever filed, no H-1B transfers ever done, no previous history of US immigration prior to April 2005.
Labor, I-140 and I-485 were filed November 2006; I-140 approved February 2007, I-485 approved June 2007, EB2 green card arrived June 2007.
There was a LUD on the I-140, in August, but that was about the same time as a bunch of other people got LUDs on cases starting SRC07... seems like I can disregard that.
There was also a LUD on the I-129 without a status change later in August. No explanation for that was apparent.
And now I get a notice on 10/23/2007 saying that the I-129 has been re-opened and that something will happen within the next 30 days. I'll be sure to keep you all updated if I get anything like an actual I-797 notice through the mail.
Did anyone else get anything on October 23rd?
Ok, so we figured it out. The case really has been re-opened... soon after I got the GC, apparently the attorneys wrote to USCIS and informed them that I'd no longer be working for my company in H status but rather in LPR status.
They asked USCIS to withdraw the LCA and the I-129 petition, so it's normal that the case eventually gets re-opened.
We're expected that USCIS will subsequently revoke the original I-129 sometime within the 30 day period that CRIS mentioned.
If anyone else is in the same boat, there's nothing at all to worry about... as long as your current status remains valid.
Any idea why it's important for the attorneys to notify USCIS that I'm no longer a H worker? The petition would expire next March anyway...

Just as an update for those anxious folks - I got my passport back with the stamp on Jan 3rd (Intv was on Dec 13th). Visa issue date was on Jan 2nd.
So plan for 'a month' atleast if you are visiting the Chennai consulate for H1b stamping.
Also make sure your photo is exact as per specs..Mine was taken in US (Costco) for the Green card process ..but the guy who is sorting all the papers in the consulate send me out to the VFS office to take another photo as he didnt like the way my photo was taken (although there was nothing obvious..no point in arguing to them)..I thought I was alone, but saw many folks outside ...I had to take this at the VFS office (close by..VFS shuttle is there outside the consulate) and return back to consulate..(will cause atleast 1.5 hours delay..I barely made it to my flight back home)..

Every company has a lawyer on its payroll so they can easily start some court case to harras you. In this country you do not have much support except some close friends and may be far off relatives. So even if you know that you have done nothing wrong and have solid case the idea of hiring a lawyer and fighting a legal battle scares a lot of people. Plus every one has a job and family responsiblities and they cannot devote time to all these things. Say you are now working in New Jersey and your old employer is based in California and files a case against you there what will happen will you have to travel to california to represent in case? what will happen to your job and expenses etc. I am not sure if these are valid concerns but just thinking of this will dissuade a person to gear up for any kind of fight.

I switched job and applied H1B transfer a month ago. To my surprise we got H1B approval in two weeks even though we selected regular processing. Today I saw soft LUD on my case, my wife case and kid's case. So far no RFEs
Even though I got my H1b approval for three years a week ago by mail, still my online H1b status is showing pending. This H1b extension is 9th year to 12th year extension :):)
