Hi when485,
Our PDs are close.Mine is jul-06 eb3/I. My family's all 485s had a soft LUD on 03/31/2009 and today 04/01/2009. I am thinking it could be because of 2nd finger print notices for our family.

I dunno about which bank is the best but I guarantee this ICICI does sucks! they act like as if they are ruling NRI. and of course like anyone else we had a very bad experience talking with their home loan dept too. Honestly - If I may say something about this....I can say this with 100% confidence that sooner or later we all will witness their demise. count on it.
The point is that they cannot JUST do this to us(NRI) or I can say it is we who made their success if they are really. but by the sheer power of community like this - we can definitely teach them a good lesson by just quit banking with ICICI. guess what you will be proud of what you did in the very near future. SBI still IS doing reasonably well and you still can get better rates though.

very good... so accordingly to you these guys should be nice to everyone and not ever tell anyone to go away, must "behave" with self righteous people like you and i. even when someone continues to show the thumb and demand answers, someone else should always be on their best behavior, otherwise u will be turned off and not show "empathy" to these guys? is that what u just said? give me a break, we need to show "empathy" ourself before we can show "empathy" to someone else. how many u years r u waiting for green card? i had a chance to go on a conference call of anti-immigrants 2-3 days back, and posted here what i heard. while u and i continue to debate and set our reasons and bar before someone else will deserve your 'empathy', get ready to get your sorry ass kicked by anti-immigrants, i am sure those anti-immigrants will not show any "empathy" to anyone here.
so while we all want to "enjoy" the freedom to discuss "free" and freely, don't forget that every freedom comes at a cost, which it doesn't look like you are willing to pay for, right?
and what will we do "discussing" freely on this or any other forum, who cares what u say anonymously on a webforum. the way i see is, we want to continue to discuss, but "free" and "freely" before u and i some show some "empathy" , while someone else is working overtime to ship our sorry ass out of there, does that make any sense?
we all want to live in an advanced society but we don't want to think and be like one, lets just ask for "free" and "freely" discussion, because all that we want is "discussion".... and go to sleep
and then u say if something happens, it will for sure be because of some other organization..... u r truly a genius....

Friend of mine (to whom I contacted regarding IV) is in USA for 7 years and knows how lobbying & party funds are raised (including Watergate) and also very much aware of "Retrogression" and problems of being "Legal".
Also, he is aware of cause of IV and appreciate that but he is un-comfortable because whenever he login to IV, he noticed that:
- more than 40-50% respondents are talking about money/contributions & signatures showing how much they have contributed as of today,
- 10-15% are talking about blocking non-contributors(calling by Free Lunchers etc..),
- 5 % are Pseudo intellectuals (talking BIG but dont know immigration basics like - PD, issues of I-140/I485)
- 5% are always trying to shutdown others, accusing/calling by names to other forum members (he says "Highly skilled" in accusing!!)
- and remaining are "Positive" contributors for IVs retrogression cause (talking about - I spoke to senators office, can we arrange rallies, when to Fax/fliers, when State chapters are going to meet, posting excerpts from senate/CSPAN/News etc..)
Is our audience is so? Can we focus on our cause? pl be together like.. Like-Minded!!!
First of all We are not into any 'gate' here...We are not creating any 'watergate' or 'immigrationgate'...
All activities we do are legal and you would eventually get the expenditure report too...
Now If you try to build any organization that is non paid completely volunteer...basis, all kinds of things do creep in...
There is no avoiding that....
Your 'friend' has a very idealized version of public organization in his mind....
But the fact is that all public volunteer based organization(especially the ones so heavily populated by 'high skilled' ones) are going to be chaotic....
The only public organizations that are not chaotic are either the Chinese communist party or paramilitary organization like fire fighters and police departments..All other organizations are going to be how you described...the different %ges..
Now you have 2 choices.....
Choice 1. Try to work with the chaos and have some voice in the legislative process...
Choice 2. Shut your self out and not have a voice at all and mind you one less voice makes our collective voice weaker....
The choice is yours to make.........

Sameet,
I know it is a weird question. But I'd still go ahead and ask it.
What documents that USCIS expects for a scenario like this?
My situation: My wife still hasn't weaned off nursing completely.
My child is 1 year 3 months old. My wife got an RFE for TB test.
Plus she is in India currently.
Would sending the birth certificate of child be enough to prove the existence of 1 yr 3 month old child? OR would USCIS requires doctors's input also? OR do they require anything else to prove baby is still being nursed.?
Thansk for your response,
GCisaDawg
The Pediatrician told us that she should not take the vaccince based on the manufacturer's literature. They gave us a letter to that effect and the Civil Curgeon then applied for a blanket waiver.

Hi all,
I got a RFE for Ability to pay for My I140(EB-3, PD-Ap2003) from USCIS. After consultation I was suggested that I needed an expert opinion letter from an Independent CPA telling that company can pay me the salary stated in the ALC. Now I need a CPA who can analyze the financials of the company and a lawyer who can write the letter to defend this case. I was wondering if anyone here can provide the service for CPA analyzation or sample letter on how to address this issue.
Thanks

I think even if we do not go as far as monetizing every aspect of IV (which I also think we shouldn't) but there should be certain privileges, which should only be there for paid members. If it pisses off a few souls, let be it.
I think, this is the least we can do as IV members, i.e. contribute (and I am sure $20 a month is not an amount folks cannot come up with) but I guess they must be enjoying the free lunch. Let them enjoy it but take away the privilege of posting new messages and getting there questions answered when they cannot even help themselves.

Exactly my thoughts. However, that does not mean that I am not proud of heritage and culture of my country-of-origin.
The vast majority of people are here on these forums for getting their GC and USC.
I appreciate everyone who has congratulated me. Thank you so much. Please note that I sill belong to legal immigrant community and nothing can change that.
Good Luck to everyone (and that includes people who have given me red dots with comments) and I hope you get your GC soon.

Proud to be an Indian-American and legal immigrant.
Anyway, I am still confused. If I am proud of my country of origin and its heritage then it must be absolutely impossible for me to entirely renounce and abjure all allegiance and fidelity with my country of origin. That is the expectation every human society or country generally have and must have to advance its own culture. Well I can not see myself fitting in that "Ethics watch" if I am changiing citizenship. If I am changing citizenship I absolutely do not have strong ethical connection with my heritage and country. And in that case it is fine to change citizenship for me and if I do that I would not speak about pride to my heritage and country. And if I am really and sincerely proud of my country of origin I would not become citizen of other country in spite of any attractive lure. It is that simple.

Folks don't get me wrong, i understand what you guys are going through. my family and close friends are in same limbo. and if any of you has spouse on H4 you will surely know the wonderful status it is to be in. All i am saying is, if there is too much demand for something, there will be a price attached to it. A British can get US gc faster then a Indian cause there are not that many british who wanna come here. and Since USCIS knows we are almost on our knees, they treat us like dirt. Once the demand goes down and more and more Indians will start to look else where, they will start treating us with respect too. Case in pint china, track its history with USCIS, Chinese no longer flock to US, in fact its US who now depends on Chinese money and all and treats its citizens with respect.

Here is another question. Its about leadership but uses immigration as an example.
"This is just one example of our political status quo: America's LEGAL immigration system is in dire need of a reform. Even though the members of Congress agree to that, they are not able to or not willing to bring about such a reform. Their hands are tied because of a certain powerful focus group who won't allow ANY immigration reform unless it encompasses a comprehensive reform of a well-known controversial issue. Innocent people always get hurt in a war. And in this conflict its the legal immigrants, who have not broken any laws, are the ones who are suffering the most. Senator Obama, as the President of the United States, what will you do, so that the voice of the people can be heard and their problems solved instead of selected powerful groups bullying the lawmakers?"
Please vote. We need have people talking about our problems. We need to bring awareness about the difference between legal and illegal immigration. The likes of Dobbs often confuse the two.
Send the letters and vote for these questions.
Thanks!

More likely cause is that the letter from the applicant notifying his new job never reached/registered in CIS systems.
Did the person send the letter in time? Was there any intermediate change in status between NOID and actual denial status?
AILA should file a lawsuit regarding these denials. They expect people to follow all H/LCA/PERM and target employers/lawyers to send a message to other people but fail to follow their own laws themselves. A lawsuit causing hardship needs to be filed. I dont know why AILA has not taken any action against this practice.

Thanks for all the replies! I already contribute to IV, so all the mails about contributing to IV can stop :) You dont need to sell me IV.
I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.
Without any reform, my guess is it is going to be 5+ years for my date to be current. Just wanted to hear a few other opinions.
Also, if there is any impending relief (like 485 filing by 2/15 thats being discussed), I would be interested in hearing about it. It would be terrible for me if I move and then a relief is passed immediately in the congress.

MurthyDotCom : MurthyBulletin (http://www.murthy.com/bulletin.html)
Conclusion
MurthyDotCom
Employers whose business model may be viewed by the USCIS as within the third-party placement are likely to face RFEs in their H1B petitions. Such employers need to review the factors set forth in the memo as indicators of control, and anticipate the need to prove control over their employees or modify their practice to incorporate the factors to establish a direct employer-employee relationship. This memo is significant to the IT consulting industry, and could disrupt many other business sectors. Absent this source of workers, the end clients would be forced to change their business models with regard to how they meet their short- and mid-term IT needs. The impact would not be limited to IT consulting companies, but would also be felt by their clients, which include many of the largest U.S. companies and even the U.S. federal government.
MurthyDotCom
The Murthy Law Firm recently has responded successfully to RFEs on the employer-employee issue. To the extent appropriate, we will utilize the new memo and USCIS update as additional guidance on acceptable evidence in such matters. The memo appears to change prior, established practice and law. It is inconsistent with other federal statutes in defining the terms "employer" and "employee." A challenge by H1B employers may be required, unless the USCIS reconsiders or modifies its position. We at the Murthy Law Firm remain available to assist our clients in connection with H1B cases, including issues that will arise as the result of this memo.

EB3 I is bad and will get worse. EB 3 ROW will also get screwed big time because of the 300k namecheck victims who are now eligible for visas. Trickle down will also be impacted because of that. USCIS uses short sighted methods to clear their hurdles, they dont realize that there is person behind each visa number. The only thing certain for EB 3 is that in OCT EB 3 will revert back to the June 08 dates.
The sad fact is that most of us were screwed because the lawyers suggested to our companies that EB3 is easier to process than EB2.

Hi All,
You know my old H1B case was reopened on Sept. 28, and the USCIS Emailed me that they sent a notice. But I haven't received such notice, my employer/attorney also didn't receive any notice. I wonder the USCIS didn't send this notice at all!
