i could be wrong, but if i remember correctly, when this ruling was published last year, if a pending 140 was filed on labor subst that would get rejected.
An approved 140 with labor subst was ok.

Can we each leave a 'personalized note' on how much we have contributed in Federal / State / Social Security taxes + Medicare / etc.???? Even a rough order estimate... to get them to listen to us seriously.
Is this something that IV can help co-ordinate?
1. State-wise, collect estimates of taxes paid till date
2. Collect the data (anonymously, of course) and send a written brief to each Senator in that state - making a clear economic case to how we contribute
3. Collect the data (nationally, with statistical analysis thrown in) and send a written brief to all Senators - making a case at a national level.
We need eye-popping numbers, charts and quotes ... to continue the PR around high skilled immigrant needs.

jsb - I received an email today from CRIS that they have issued an RFE on my I-485. I am EB-3 India September 7, 2007 I-485 filer with a PD of June-2005. Like you said, they do not consider country of chargeability until the case is all set to approve.
Otherwise, why would they touch a EB3-I case with PD of 2005.
I am not sure what are they looking for in FRE. I want to get out of this game now....one way or the other!
"EB Applications pending from India" is very vague, and most probably is not what we are looking for.

To start any New Thread , we should check whether post is from monthly recurring payer, if so he gets to start new thread else for each new thread charge $1.

Though it is proven time and again that CP filers are the least needed people on this forum (next to EB3 I - going by this thread), it is unfair not reserving few columns on the profile for CP filers ... It doesn't cost VISA numbers for that...
2. I have told this before but would like to repeat now... I don't contribute because there is nothing for CP filers here. VISA recapturing is the only effort that would benefit CP filers but anyway the chances of that bill passing is close to 0.
In my opinion, the biggest sufferers are people in EB3 India or China and who have opted for CP (now guys, don't start lecturing on CP vs. 485. We have heard it enough).

What some people forget on this forum is there was a guy not too long who was dying in six months and I am sure most of our situations are not so dire. Look we all will get GC, we are AOS pending it is a matter of a year here and a year there. But please do not fight like this, we are a community. I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.
Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.

I think DATE OF DELIVERY matters.
I clarified this by looking at the records in tarckit. There were people filed on 05/31/2007 to reach on 06/01/2007 and got the the receipt.

eb3_nepa's request is valid in the context that spouse of an L1 can take up any Job.. & the spouse of the proposed 'Blue Card" can take up any job.. why not a H4?

On the other hand for those ones that say that we (H-4s) could apply for H-1B easily, it is not easy if you are not in IT. Some people said -although doesn't make much sense looking that L-1 and Blue card spouses would be able to work-, that if you do not want the H-4s to compete with average joes?, then an intermediate solution is to require a Bachellor degree minimum education requirement for getting the H-4s a H-4B (my new name for employment authorization), yes, dependend on the H-1B, if the H-1B is laid off the H-4 would still have the chance to apply for H-1B (without counting in the yearly quota) or leave the country after 6 months. Why should we get a F-1 visa?, most of us arrived highly educated.

I appeared for an interview on Jan 2nd. It took the consulate officers 16 days to call me and ask for original documents again. Darn PIMS verification! I resubmitted the documents on Jan 22nd through the drop box... and have been calling them daily to track the progress. They say they need 7 working days from the day the documents are received. I have already had to reschedule the flights once..and my employer is getting worried now. If I had known about the delays at Chennai post before, I wont have applied here. Chennai sux!!!

With ICICI it was extremely easy to open a loan,they even opened the office on a Sunday to get it done.
But they are making it extremely hard to close the loan.
Couple of times they send us letters asking us to do outstanding payments when there were no outstanding payments. Then we went to the branch and sorted out and manager gave a letter confirming everything was clear.After an year we get another letter regarding the same payment and again we went to the bank and bank manager apologized when we told we are going to file a case.
Also we saw few other customers there with the same issue while waiting.
Now we trying to close the full loan by paying off everything but the bank says if we pay in advance there is a big penalty.
These guys are too much.
Iam not sure if this is a proboem with their system or if it is a malpractice, but I would sacrifice service for honesty.

This may not be related to this issues but I saw an update of 09/25/2007 on my H1 case with a previous employer whom I left in 2004. This case was approved in 2003.

It is completely unpredictable. Actually when you file I485 USCIS does not process FIFO(They are supposed to). For example there are 10k gc are left for the year. First they will process the applications which are cleared FP based on PD and receipt date. Always risk is there when filing without marriage. You are safe till USCIS starts process your application. When they take your application for processing then you cannot add your spouse. Also if CIR decides to process backlogs faster then also you will be in problem. Best option is if your marriage is already fixed do it within 3 months and file GC before PD is backdated. You need not file July first. You can wait till Jul15 to see next VB and decide.

I was banking on that being FIFO so I could safely assume that my 485 wont be processed before the next retrogression kicks in in a couple of months -- giving me ample time to get married and bring my wife on H4!! :( :( And I do plan to get married in the next 6-9 months :(
